§ 17.24.030. Submittal of ownership evidence.

    The subdivider shall present to the recorder evidence that, at the time of the filing of the final or parcel map in the office of the recorder, the parties consenting to such filing are all of the parties having a record title interest in the real property being subdivided whose signatures are required by this title as shown by the records in the office of the recorder; otherwise, the map shall not be filed.

    B.

    For purposes of this section and Sections 66436, 66439 and 66447 of the Government Code, a public entity which has obtained a prejudgment order for possession of property pursuant to Section 1255.410 of the Code of Civil Procedure shall be deemed to be the record title owner of the property or property interests described in the order, provided the order for possession has not been stayed or vacated pursuant to Sections 1255.420, 1255.430 or 1255.440 of the Code of Civil Procedure, no motion therefor is pending before the court, and the time prescribed by Section 1255.420 of the Code of Civil Procedure for filing a motion for relief from the order has passed.

    C.

    Notwithstanding subsection (A) of this section, with respect to a division of land into four or fewer parcels, when dedications or offers of dedication are not required, the certificate need only be signed and acknowledged by the subdivider.
